CJI Chandrachud Advises Probe Agencies to ‘Pick Your Battles’, Applauds New Criminal Laws

Chief Justice of India (CJI) Dhananjaya Y Chandrachud delivered an insightful address on Monday, advocating for a strategic focus by premier probe agencies like the Central Bureau of Investigation (CBI) on cases that pose significant threats to national security, public order, and economic well-being. In his remarks during the 20th DP Kohli Memorial Lecture, organized by the CBI, CJI Chandrachud emphasized the importance of streamlining investigations and upholding due process in law enforcement.

He expressed concerns over the tendency of investigative agencies to spread themselves too thin, particularly citing instances where the CBI had been tasked with investigating cases involving minor bribes. He urged for a more focused approach, directing attention and resources toward addressing crimes with profound implications for the nation.

CJI Chandrachud also commended the enactment of three new criminal laws – Bharatiya Nyaya Sanhita (BNS), Bharatiya Nagarik Suraksha Sanhita (BNSS), and Bharatiya Sakshya Adhiniyam (BSA) – which are set to replace outdated colonial-era legislation from July 1. These laws aim to modernize the criminal justice system by digitizing various aspects of criminal procedure and evidence gathering.

Highlighting the integration of technology into the legal process, CJI Chandrachud noted that the new laws facilitate the electronic issuance of summons and virtual testimonies, thereby streamlining communication and expediting legal proceedings. He underscored the potential of these innovations to enhance efficiency and accessibility within the criminal justice system.

Moreover, CJI Chandrachud stressed the importance of striking a balance between investigative imperatives and individual privacy rights. He cited provisions in the new laws that empower courts and law enforcement agencies to summon digital evidence, while also cautioning against unwarranted raids and confiscation of personal devices that infringe upon privacy rights.

Looking ahead, CJI Chandrachud advocated for a reevaluation of investigative frameworks to address evolving challenges posed by sophisticated criminal networks. He proposed the formation of multidisciplinary teams comprising law enforcement officers and domain experts to bolster investigative capabilities and adapt to changing criminal dynamics.

While endorsing the use of technology such as artificial intelligence (AI) to strengthen the criminal justice system, CJI Chandrachud emphasized the need for ethical considerations and robust safeguards to prevent misuse. He underscored the importance of clear guidelines to govern the ethical deployment of technology in law enforcement.

Overall, CJI Chandrachud’s address highlighted the imperative of maintaining a delicate balance between law enforcement imperatives and individual rights, while also embracing technological advancements to enhance the efficacy and fairness of the criminal justice system.
