Recently, a man appealed in front of a Mumbai court to reduce the maintenance amount that he has to pay to his estranged wife. The metropolitan magistrate at Bandra, Mumbai has dismissed the appeal from the man. The man has to pay maintenance to the woman under the Protection of Women from Domestic Violence Act. The court denied the appeal while quoting the reason as her pet dogs “fulfilling emotional deficits” that arise after the breakdown of relationships. The court has thus ordered the husband to pay his wife for the maintenance of these pet dogs as well.
A considerate verdict from Mumbai court for pet dogs
While presiding over an interim maintenance case brought by a 55-year-old lady under Section 12 of the DV Act, Bandra metropolitan magistrate – Komalsing Rajput made an interesting statement. The woman asked for maintenance, including money to care for her three Rottweiler dogs as pets. The husband objected to this request, saying that it shouldn’t be used as justification for maintenance.
While the Magistrate declined the plea from the man, he emphasized that dogs are an integral part of respectable lifestyle and play a crucial role in enabling individuals to lead healthy lives by filling the emotional void caused by broken relationships. The judge consequently decided that the husband’s argument could not be used as justification for a reduction in the amount of maintenance.

What is the amount to be paid by the man?
Shweta Moray, the woman’s advocate, filed the plea on her behalf, accusing her husband of domestic abuse. She submitted an application along with the allegations asking for a 70,000 bucks maintenance payment each month. On June 20, the court partially accepted the plea and ordered the husband to give the wife Rs. 50,000 as interim maintenance until the issue was finally resolved.
The court considered the state of each party’s finances while making its decision and concluded that the husband’s accusations of business losses had any merit. The court further stated that the wife’s upkeep should be in accordance with her lifestyle and other basic needs.
Due to her dependency status, the woman, who was unwell and had no source of income, requested interim maintenance. She made a point of displaying the three Rottweiler dogs under her care.
