Vehicles With Pending Toll Dues To Face Curbs On NOC & Fitness Certificates

The government on Tuesday announced stricter regulations on toll payments across National Highways, stating that vehicles with pending toll dues will be denied access to essential registration and permit-related services.

The move aims to ensure higher compliance with user fee payments and curb toll evasion.

To enforce the changes, the Centre has notified the Central Motor Vehicles (Second Amendment) Rules, 2026, introducing revisions to the Central Motor Vehicles Rules, 1989.

The amendments seek to strengthen electronic toll collection and support the rollout of barrier-free tolling systems nationwide.

Under the revised rules, the government has introduced a formal definition of ‘unpaid user fee’.

This refers to toll charges for National Highway usage where the Electronic Toll Collection (ETC) system records a vehicle’s passage, but the applicable fee remains unpaid under the National Highways Act, 1956.

The amendments directly connect toll payment compliance with critical vehicle-related services.

Authorities will refuse to issue a No Objection Certificate for vehicle ownership transfer or interstate movement until owners clear all outstanding toll dues.

Vehicles with unpaid toll charges will also be ineligible for obtaining or renewing a Certificate of Fitness.

For commercial vehicles, the rules mandate zero pending toll dues as a prerequisite for securing a National Permit.

The Ministry of Road Transport and Highways has also updated Form 28, requiring applicants to declare any pending toll demands. Parts of the form can now be issued electronically.

Officials said the changes will support the upcoming Multi-Lane Free Flow (MLFF) system, enabling seamless, congestion-free tolling across highways.
