The Supreme Court has expressed its displeasure over the failure to form Transgender Welfare Boards, despite its previous order. The Court has now given the states a final opportunity to submit their responses, warning them that if they fail to do so by the next hearing, a fine of Rs 20,000 will be imposed on each state.
This issue arose from a petition filed by Kinnar Maa, a social organization. The petition argues that the government has not yet established a proper board to address the issues faced by the transgender community.

It highlights the lack of access to basic services such as healthcare and education and the indifference of the police to cases of abuse or sexual assault against transgender individuals. The petition further states that despite the Supreme Court’s directives, transgender people are still denied reservations in education and employment.
During the last hearing, a lawyer representing the Bihar government informed the Court that the state had taken all necessary steps to protect the rights of the transgender community, including the establishment of a Transgender Welfare Board. The board is responsible for monitoring the social development of the community and implementing measures for their empowerment. The board includes transgender members to ensure recognition and inclusion.
Similarly, the Haryana government has also formed a Transgender Welfare Board, with the state’s Chief Secretary appointed as its chairman. High-ranking officers from 10 departments, including the Director-General of Police, will also be part of the board.
The Uttar Pradesh government has issued a notification to establish a similar board, aimed at protecting the rights of transgender people. The board will ensure their access to health, housing, education, skill development, and legal services. It will also work to eliminate discrimination against transgender individuals in homes, workplaces, and public spaces.
The Court’s ultimatum underscores the urgency of providing proper support and protection to the transgender community, emphasizing that the rights of these individuals should no longer be overlooked.
