SC Hearing on GST, Customs, & CrPC Provisions For Accused On March 17

India’s Supreme Court will hear cases concerning provisions under the GST and Customs Acts, as well as the Criminal Procedure Code (CrPC), focusing on the rights of accused individuals.

Key Issues Addressed In The Petition

A petition challenges provisions under the GST Act, Customs Act, and the Prevention of Money Laundering Act (PMLA).

It questions whether authorities are misusing the powers granted to them, particularly regarding the arrest and detention of accused individuals.

The petition also calls for clarity on the issue of anticipatory bail for individuals fearing arrest under these laws.

The court aims to examine whether these provisions balance adequate protections for personal liberty.

During earlier hearings, the Supreme Court expressed concerns about the misuse of power during arrests, emphasizing that the legal framework should not allow for arbitrary action.

The Legal Framework Under GST & CrPC

The court examined the application of Sections 69 (arrest power) and 70 (summons power) of the GST Act, along with provisions from the Customs Act, and the CrPC.

It has emphasized the need for authorities to follow prescribed protocols and not engage in coercive actions during investigations.

Additionally, the court directed the government to provide data on arrests made under these provisions to assess their impact.

The Supreme Court’s upcoming ruling will be pivotal in shaping the future interpretation of legal provisions under GST, Customs, and the CrPC.

The court is focusing on balancing the government’s right to enforce taxation laws with individuals’ constitutional rights, protecting them from wrongful arrests and arbitrary actions by authorities.
