Delhi Law Minister Kapil Mishra has been issued a notice in a case concerning the alleged violation of the Model Code of Conduct during the 2020 Delhi Assembly Elections.
The Rouse Avenue Court has refused to stay the order passed by the lower court and has scheduled the next hearing for May 19.
Mishra had previously filed a reconsideration petition, challenging the summons issued against him by the Magistrate’s court.
The case stems from the 2020 Delhi Assembly Elections, where the Bharatiya Janata Party (BJP) nominated Kapil Mishra to contest from the Model Town constituency.
The petition concerns his alleged breach of the Model Code of Conduct during the election campaign.
The Rouse Avenue Court had earlier dismissed Mishra’s plea to overturn the summons issued by the Magistrate Court.
In response to the case, Mishra had challenged the Magistrate’s order that summoned him based on the charges filed against him.
However, the court did not entertain the petition and emphasized that Mishra must face legal proceedings as the matter is related to election laws.
Mishra’s political journey has seen several significant shifts. Initially a part of the Aam Aadmi Party (AAP) government led by Arvind Kejriwal,
Mishra was later expelled from AAP and joined the BJP.
He recently won the Karawal Nagar seat in the Delhi Legislative Assembly elections.
This case against him raises questions about his involvement in the alleged violation of election conduct during his campaign for the 2020 Assembly elections.
Despite his political success in Karawal Nagar, Mishra’s legal issues surrounding the 2020 election have continued to attract attention.
His legal team had hoped for a favorable ruling from the court to avoid the legal proceedings, but the court has maintained its stance, upholding the original decision.
Kapil Mishra’s case is a crucial one for both political and legal observers, as it underscores the importance of adhering to the Model Code of Conduct during elections.
The outcome of this case could impact future election-related legal cases, especially concerning the accountability of political figures.
The legal battle surrounding Kapil Mishra’s alleged violation of the Model Code of Conduct during the 2020 Delhi elections will continue to unfold as the court prepares for the next hearing in May.
This case highlights the challenges faced by political figures when dealing with election-related misconduct allegations.
