The Delhi High Court has refused to grant anticipatory bail to a film director accused of raping a girl and clicking her obscene photographs.
The High Court rejected the anticipatory bail plea of a film director named Sanoj Mishra and said that this was not a case of a person applying for bail after his arrest.
This is a case of anticipatory bail of a film director. This person is accused of repeatedly raping a girl from a small town who aspires to become a heroine.
Granting anticipatory bail in such a case will send a wrong message to society.
It will create a perception among the people that even after sexually exploiting such girls, someone can escape without any punishment.
In this case, the film director argued that the girl had made relations with the film director of her own free will.
The girl has said in an affidavit in the court that the FIR was the result of a misunderstanding.
And if the accused gets bail in this case, then she has no objection.
However, the court did not accept this argument. The court said that it could not grant bail to the girl in this case as there was no objection to the bail.
The allegation in this case is that the film director has made obscene photos and videos of the girl and has threatened to make them public in case she does not agree to his demands.
In such a situation, the court does not think that the girl is saying that she has no objection to granting bail of her own will (without any pressure).
The court said that, in this case, someone had forced the girl to undergo an abortion several times. It is necessary to take her into police custody and interrogate her to get information about her and to obtain obscene videos or photos.
Therefore, the court is rejecting the application for anticipatory bail.
