Adani US Case Ends: Senior Advocate Vikas Pahwa Explains Why Charges Were Dismissed

Senior Advocate Vikas Pahwa said the criminal proceedings involving Gautam Adani and Sagar Adani in the United States have formally ended after the charges were dismissed.

Pahwa described the development as significant for the Adani Group. The case received widespread attention following the indictment last year.

Pahwa said the US Department of Justice had clarified the alleged bribery transaction. The transaction took place in India rather than within US territory.

According to Pahwa, this raised questions about the jurisdiction of US authorities over the allegations.

The US court accepted the federal prosecution’s request to withdraw the indictment after reviewing the reasons submitted by prosecutors.

The decision ends allegations associated with an alleged bribery arrangement connected to an Indian solar power contract and claims involving US investors.

Pahwa said the Department of Justice had cited multiple grounds while seeking withdrawal of the charges.

Prosecutors argued that they should not have initiated the case. They also raised concerns about the circumstances surrounding the original indictment. They questioned its timing as well.

Pahwa said the court’s order provides a conclusive outcome for the proceedings against the Adanis in the United States. He explained that a criminal indictment dismissed through a judicial order is difficult to bring back under the applicable US legal framework.

Pahwa also highlighted the court’s role in examining the prosecution’s request before granting approval. He said the federal court sought further explanations and documentation from the Department of Justice before deciding whether the proposed withdrawal was justified.

Following the ruling, Gautam Adani welcomed the court’s decision and expressed respect for the judicial process.

The Adani Group Chairman said his confidence in truth, fairness and the rule of law remained firm throughout the proceedings. He also thanked those who continued to support him and expressed his determination to contribute to India’s development and create lasting value.

The dismissal has brought the US criminal proceedings involving Gautam Adani and Sagar Adani to an end.
