Concerned by political instability, the Centre appointed a committee led by YB Chavan to study defections. This led to the 52nd Constitutional Amendment in 1985, introducing the Anti-Defection Law under the Tenth Schedule.
The law allows the disqualification of MPs and MLAs who defect or violate party whips, while permitting mergers backed by two-thirds of legislators. It was further strengthened by the 91st Constitutional Amendment in 2003.
Although the law significantly reduced the frequency of ‘Aya Ram, Gaya Ram’ style defections, debates continue over its impact on legislators’ independence.
Recent political developments in several states demonstrate that the anti-defection law remains a crucial element of India’s democratic and political landscape.
