The Supreme Court will hear the petition challenging Section 64 of RPC on March 20. Section 64 of CrPC has been challenged based on discrimination against women and delay in getting justice due to delay in summons.
Let us tell you that there is a provision in Section 64 of CRPP that the summons cannot be accepted by the lady of the house on behalf of the summoned person. The provision says, “Where the person summoned cannot be reached despite all efforts, the summons may be served on him by any adult male member of his family residing with him, except one in duplicate.
Actually, Section 64 of CrPC has been challenged. According to this section, the court summons cannot be accepted by the lady of the accused’s house on behalf of the accused. Only that person has to be accepted. In the petition it has been described as discriminatory against women. Because of this, this section is also the reason for delay in getting justice. The Supreme Court should consider this.
