High Court rejected Jaya Prada’s petition filed against non-bailable warrant

ALLAHABAD

The  Allahabad High Court has rejected  the application of former film actress and Jaya Prada  on the basis of withdrawal of the petition.

Mr Justice Sanjay Kumar Singh rejected the petition on the pleadings of the petitioner council that they want to file a new application with some new facts and new documents.

On this basis the council sought permission from the court to withdraw both the petitions on this basis. The court accepted the request of Jayaprada’s lawyers and allowed the petitions to be withdrawn. The court rejected the applications on the grounds of withdrawal.

According to the prosecution both the cases against Jayaprada were registered in the 2019 Lok Sabha Elections, relating to violation of the code of conduct. Despite summons being issued from the District Court of Rampur, Jayaprada was not appearing in the court.

A non-bailable warrant was issued against Jayaprada in the district court of Rampur when she did not appear in the court despite the same being issued several times.

Despite non-bailable warrant being issued seven times, Jaya Prada did not appear before the court. Recently, the MP-MLA special court headed by Justice Shobhit Bansal has now directed the Superintendent of Police to form a special team under the leadership of Deputy SP to ensure their presence in the court by March 6.

This legal provision is invoked when an accused person fails to appear in court despite a warrant, triggering the proclamation process to ensure his attendance. Jaya Prada first became a Rajya Sabha MP and then a Lok Sabha MP.
