Delhi High Court Rejects Plea Against Demolition Of Pracheen Shiv Mandir

In a recent development, the Delhi High Court has dismissed a plea filed by the Pracheen Shiv Mandir Avam Akhada Samiti against the demolition of the Pracheen Shiv Mandir located near the city’s Geeta Colony, close to the Yamuna Flood Plains.

Justice Dharmesh Sharma presiding over the case stated that the petitioner failed to provide evidence of any legal rights allowing them to continue occupying the civic property for temple services.

The court rebuked the plea’s attempt to involve Lord Shiva in the legal matter, stating that the deity doesn’t require human protection, but rather people seek his blessings.

Justice Sharma emphasized the importance of clearing encroachments and unauthorized constructions from the Yamuna River bed and flood plains.

The plea sought to keep the temple operational for devotees, claiming it served as a central hub for spiritual community activities, attracting hundreds of devotees regularly for prayers and worship.

The court rejected the plea, noting that the Delhi Development Authority (DDA) developed the temple on the Yamuna flood plains as per the directives of the National Green Tribunal.

The court granted the petitioner society 15 days to relocate the idols and religious objects to another temple.

If they fail to do so, the DDA is directed to place the idols in an appropriate temple.

The court also authorized the DDA to proceed with the demolition of unauthorized constructions, instructing the petitioner society not to obstruct the process.

Furthermore, the court ordered local authorities to provide full assistance in maintaining law and order during the demolition process.
