Delhi High Court Criticize MCD For Inaction On Unauthorized Construction

The Delhi High Court has sharply criticized the Municipal Corporation of Delhi (MCD) for failing to act on a Supreme Court order regarding unauthorized construction in Rajokri. Justice Sachin Dutta expressed frustration over the MCD’s inaction, condemning the corporation for allowing large-scale illegal construction to continue unchecked. Justice Dutta highlighted that the MCD’s passive approach had rendered it a helpless spectator, unable to curb the rampant unauthorized building activities.

Court Orders Immediate Action and Inspection

The High Court has directed the MCD to promptly inspect the extent of unauthorized construction on the disputed land and to halt illegal construction in the surrounding areas. Justice Dutta insisted that the MCD must not use confusion over land Khasra numbers as an excuse to delay action. He also ordered the corporation’s appellate authority to expedite the hearing of pending appeals and issue decisions without further delay.

Despite the court’s directive, the petitioner reported that the MCD did not take steps to stop the ongoing illegal construction. The MCD had previously issued a demolition order, which led to an appeal before the tribunal. The tribunal had instructed the MCD to provide land occupiers an opportunity to present their case by January 18 and to issue a new order within a month. The MCD failed to meet this deadline and reissued a demolition order on March 26. The tribunal is still reviewing the appeal, and the court has criticized the MCD for its inadequate response to the continued unauthorized construction.
