Delhi HC To Hear Swamy’s Plea On Rahul Gandhi’s Citizenship

The Delhi High Court will hear a Public Interest Litigation (PIL) filed by senior BJP leader Subramanian Swamy on Wednesday. The plea seeks directions for the Union Home Ministry to cancel Rahul Gandhi’s citizenship. The petition alleged that the Congress leader has declared himself a British citizen.

According to the court’s causelist, a bench led by Chief Justice Manmohan will address the matter. In a previous hearing, the bench noted that a similar petition is pending before the Allahabad HC. The bench instructed the Union government’s standing counsel to obtain a copy of that petition and its status.

Additionally, the Delhi HC suggested avoiding simultaneous litigation on the same issue in different forums. “We intend to ensure that we do not usurp the other High Court’s jurisdiction,” the bench remarked.

Swamy’s petition requests the Home Ministry to provide a status report on the complaint he filed against Gandhi and to resolve it promptly. In 2019, Swamy wrote to the Ministry, alleging that Gandhi had violated regulations by informing the UK government of his British nationality and passport.

According to Swamy, this declaration means Gandhi no longer qualifies as an Indian citizen under Article 9 of the Constitution and the Indian Citizenship Act, 1955. He pointed out that a company named Backops Limited, registered in the UK in 2003, listed Gandhi as a director and secretary. Documentation from the company indicated that Gandhi’s date of birth is 19/06/1970 and his nationality is British.

In his petition, Swamy expressed frustration over the lack of updates from the Home Ministry regarding his representations. “No action has been taken or intimated to me,” he stated.

Thus, the petition calls for the Home Ministry to provide a status report on Swamy’s complaint.
