Delhi Chief Minister Arvind Kejriwal Denied Interim Bail by Rouse Avenue Court

The Rouse Avenue Court has not granted Delhi Chief Minister Arvind Kejriwal, who is in jail in connection with the Delhi liquor policy case, any respite. Arvind Kejriwal’s request for an interim release has been denied by the Rouse Avenue Court. The jail administration is required by the court to perform any necessary medical testing. The court had postponed the ruling on June 1 after the arguments of both the parties. Kejriwal’s attorney informed the court that upon his surrender on June 2, three separate weight-measuring devices were utilized at Tihar Jail, and three distinct readings were displayed to Kejriwal.

Kejriwal’s lawyer said that there are concerns about health

According to Kejriwal’s attorney, there are worries over the chief minister of Delhi’s health. The court stated that Kejriwal may submit an application and it will be taken into consideration if there are any concerns. Kejriwal’s judicial custody period has been extended by the court to June 19. Through video conference, Kejriwal was produced in the Rouse Avenue Court following the conclusion of his judicial custody period. Let us inform you that at the hearing on the petition for temporary bail, the Department of Education (ED) objected to the bail and stated that the PMLA law’s section 45 should be observed whether the bail is regular or interim. Additionally, the ED had stated that Kejriwal’s regular and interim bail requests were not worthy of a hearing.

Additionally, ED claimed that although trial courts are not endowed with unique rights under Article 42 of the Constitution, constitutional courts such as the Supreme Court and High Court are. Kejriwal should file a section 45 complaint with the Delhi High Court, according to ASG SV Raju. Raju had stated that the trial court was unaware of Kejriwal’s Supreme Court petition requesting an extension of interim bail. The Supreme Court Registrar rejected his application; Kejriwal has concealed these details. Attorney General Tushar Mehta has stated that the trial court’s ability to modify interim bail granted by the Supreme Court is the matter at hand.

Interim bail has been sought on the basis of health

Appearing on behalf of Kejriwal, senior counsel N Hariharan refuted Solicitor General Tushar Mehta’s arguments, asserting that all of the claims are untrue and that the facts presented in the case are beyond question. According to Hariharan, temporary bail has been requested due to health concerns. Additionally, Hariharan had stated that the trial court had received a proper bail plea filed in accordance with the Supreme Court’s ruling. In reference to interim bail, Hariharan had stated that a normal bail petition had been filed in the trial court as a result of the Supreme Court’s exemption from filing a bail petition.
Hariharan had said that Kejriwal’s health is bad, due to which he had to come to the trial court. Hariharan had said that the ketone level is very high, his sugar level is fluctuating. Therefore, it is necessary to get him tested.

Kejriwal was arrested by ED on March 21

ASG SV In his ED appearance, Raju referred to Kejriwal’s weight loss claim as untrue. He had claimed that Kejriwal weighed 65 kg when he was released from prison, having weighed 64 kg when he entered. Raju has previously stated that Kejriwal was receiving a sugar reduction medication. He had said that Kejriwal had not even brought up the elevated ketone level with his physician. It is noteworthy that the Supreme Court had postponed making a verdict on the appeal contesting the legality of his arrest by the ED in the PMLA case until May 17. On March 21, Arvind Kejriwal was taken into custody by ED.
