Delhi HC Grants Injunction Against Infringers And Uploaders After Aaradhya Bachchan Moved Court Over Fake Death News

A few days ago, it was reported that Aaradhya Bachchan and her guardians, Aishwarya Rai Bachchan and Abhishek Bachchan, had filed a complaint with the Delhi High Court regarding fake news reporting. The parents of the 11-year-old girl, Abhishek Bachchan and Aishwarya Rai Bachchan, decided to sue the infringers and uploaders for circulating false information about the girl’s fictitious death and illness report, which did not go over well with them. The hearing took place on April 20. The court issued an injunction prohibiting the violators and uploaders from uploading the violating videos and any other content that violates the privacy of others and spreads false information about Aaradhya Bachchan.

Aaradhya Bachchan files a case in the Delhi High Court

With the assistance of her parents, Abhishek and Aishwarya Rai Bachchan, Aaradhya Bachchan filed a lawsuit in the Delhi High Court to prevent YouTube channels and uploaders from spreading false information about her death or critical illness. Sections on privacy breach, defamation, and infringement of personality rights were filed in the suit. The High Court issued an order stating that “All children to be treated with parity” in a landmark decision.

High Court’s statement

“It is a landmark judgment on three counts – injunction which upholds the privacy of a child; an injunction against disseminating false and fake news about a child that is harmful to a child, and against defamation,” said lawyer Ameet Naik, who represented Abhishek Bachchan in the High Court. The court has stated that intermediaries should have a zero-tolerance policy on such fake news that is harmful to children, similar to that for child pornography. Children must be treated equally, whether they are celebrities or not. Other than that, in its structure, the court has likewise coordinated with Google/YouTube to provide subtleties about the infringers, for example, contact numbers, email ids, and so on.

Advocate Dayan, who went with Naik, contended that despite this, these recordings are bogus, phoney, slanderous, and transferred with the end and purpose of acquiring eyeballs and adding viewership and membership to the channel.

It is anticipated that the current judgement will be the first of its kind to protect the rights of a celebrity’s minor child.
