Allahabad High Court taking strict note on recording the statement of witnesses in the case or affecting the trial process due to the strike of the advocates, held that if the advocates are found guilty in the case, contempt action will be taken against them.
While hearing the bail applications of Noor Alam and others,Mr Justice Ajay Bhanot, directed the UP Bar Council to take disciplinary action against such advocates under professional misconduct and approved the bail application of Noor Alam .
The court has also issued guidelines in this regard in view of the adverse impact the lawyers’ strike is having on the examination of witnesses and trial of cases and the adverse impact it has on the disposal of cases.
Meanwhile it was also held that if the testimony in a case is stopped due to the strike of the advocates or the cross-examination of the witness is hindered, then the advocates guilty of this will be considered guilty of professional misconduct.
