Chief Justice of India Surya Kant on Wednesday expressed serious concern over Delhi’s worsening air quality, saying the pollution had made it difficult even for him to go for a morning walk.
He raised the issue during the SIR case hearings. Senior advocate Rakesh Dwivedi, representing the ECI, requested an exemption from physical appearance due to congestion and health concerns.
The CJI asked whether the difficulties were linked to the city’s air quality, and Dwivedi agreed.
CJI Surya Kant remarked, “The only exercise I do is walking. But even that is difficult now. Yesterday I walked for 55 minutes, and till morning I had problems.”
Senior advocate Kapil Sibal also confirmed he had stopped walking entirely, adding, “To breathe this obnoxious air at our age.”
He highlighted that the Air Quality Index (AQI) remains dangerously high even in the evenings.
Advocate Rakesh Dwivedi requested the Supreme Court to allow virtual appearances until air quality improves.
The CJI said the matter required consultation with the Bar Association, stressing that any decision should be a uniform rule.
He assured that he would meet the bar association bearers at the Constitution Day function later in the day to discuss proposals.
Earlier, Justice PS Narasimha had urged lawyers to shift to virtual hearings, warning that Delhi’s ‘very, very serious’ pollution levels could cause permanent health damage.
“The Situation is very, very serious! Why are you all appearing here? We have the virtual hearing facility. Please avail it. This pollution will cause permanent damage,” he remarked.
The apex court’s remarks underline the growing health hazards caused by Delhi’s toxic air, prompting discussions on adopting virtual hearings for the safety of lawyers, judges, and court staff.
The issue highlights the urgent need for measures to protect public health amid dangerously high pollution levels in the national capital.
