The Additional Chief Judicial Magistrate (ACJM) Court in Kuchaman has directed the registration of an FIR against police personnel accused of assaulting a complainant inside a police station and allegedly implicating him in a false case.
The court also ordered an independent investigation by an officer posted outside the Kuchaman Circle and instructed the Superintendent of Police, Didwana-Kuchaman, to personally supervise the inquiry.
The matter arose from allegations that a complainant, who approached Chitawa Police Station with a grievance, suffered an assault inside the premises on October 14, 2025.
The complainant alleged that the incident caused a ruptured eardrum. After failing to obtain relief from senior police authorities, he moved the court seeking intervention.
According to the complaint, a financial dispute existed between the complainant and another individual, Pramod Kanwar.
Police had previously found Case No 166/2025 against the complainant to be false during the investigation.
Despite this, the complainant alleged that officials misused their authority, behaved improperly and detained him under Sections 126 and 170 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).
During the hearing, the court expressed serious concern over the police inquiry. It noted that the report submitted by the Circle Officer lacked statements from independent witnesses and appeared to have been prepared without an adequate evidentiary basis.
The court also criticised the failure to submit certified and unedited CCTV footage despite explicit directions. It further observed that repeated requests for factual reports from the Superintendent of Police yielded no response.
Finding the allegations serious, the court ordered the immediate registration of an FIR and directed an independent probe.
The court fixed September 10, 2026, for submission of the investigation progress report and findings.
