Gitanjali Angmo, the wife of climate activist Sonam Wangchuk, has approached the Supreme Court challenging his arrest under the National Security Act (NSA).
The petition is filed under Article 32, where Sonam Wangchuk is accused of inciting violence in Leh through his speeches.
He was arrested under the NSA on September 26 and subsequently sent to Jodhpur jail in Rajasthan.
Gitanjali has written a letter to President Droupadi Murmu, demanding her husband’s unconditional release. She urged the President, as a tribal, to understand the sentiments of the people of Ladakh.
She stated that her husband’s work for the past four years has been subject to surveillance. Gitanjali’s petition alleges that her husband’s arrest is illegal.
She stated that it has been a week since his arrest, but the reason for his arrest remains unclear. They have filed a habeas corpus petition seeking Sonam Wangchuk’s immediate release.
The petition will be mentioned before a bench headed by Chief Justice BR Gavai on Monday, seeking an early hearing.
It should be noted that Sonam Wangchuk previously gained attention when he began a hunger strike to press for various demands, including the inclusion of Ladakh in the Sixth Schedule.
He reached Delhi after a 700-kilometre march. Police detained approximately 120 people accompanying him. he was stopped as soon as he entered Delhi.
The Delhi Police stated that the reason he was detained was under Section 168 of the Indian Penal Code, which was in effect in the area, prohibiting groups of more than five people.
