Delhi High Court Cracks Whip On Illegal Cafes; Orders Swift Action In Majnu Ka Tila Hotspots

In a sharp warning to civic authorities and errant businesses, the Delhi High Court has directed the Delhi Development Authority (DDA), the Municipal Corporation of Delhi (MCD), and the Delhi government to act decisively against illegal cafes, restaurants, bars, nightclubs, and hotels operating in Majnu Ka Tila and New Aruna Nagar.

The court made it clear that unauthorised commercial activity, especially along the Yamuna river bank, will no longer escape scrutiny.

A Bench led by Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela heard a public interest litigation that flagged rampant violations of building norms, fire safety rules, and zoning regulations in the area.

The petition painted a grim picture of multi-storey structures running hospitality businesses without sanctioned building plans and basic safety clearances.

The petitioners urged the court to order immediate inspections and enforcement by the MCD and Delhi Fire Services, stressing that authorities had failed to implement the National Building Code and mandatory fire safety standards.

They warned that unchecked commercialisation in residential and environmentally sensitive zones posed a direct threat to life.

During the hearing, counsel for the DDA informed the court that the authority had already registered a suo motu complaint on the Special Task Force portal after reviewing the allegations.

Taking note of this submission, the High Court disposed of the PIL but issued firm directions to ensure that authorities follow through with concrete action.

Court Signals Zero Tolerance

The court ordered the DDA, MCD, and other concerned departments to examine the grievances raised by the petitioners and take all actions warranted under law.

It stressed that enforcement must move with urgency and directed civic bodies to complete the exercise preferably within three months.

In a pointed oral remark, Chief Justice Upadhyaya noted that a large student population frequents the area, underlining the seriousness of the safety risks involved. In a lighter but telling comment, he observed that ‘except the Momo cart, everything shall be removed,’ signalling the court’s impatience with rampant illegal commercial activity masquerading as urban culture.

The PIL highlighted alarming structural violations, claiming that several buildings rise seven to eight storeys with illegal basements, rooftop cafes, and recreational facilities.

It warned that most buildings lack usable staircases beyond the third or fourth floor, relying instead on small, low-capacity lifts that could fail during emergencies.

Where staircases exist, the plea alleged, they remain narrow, poorly lit, and badly maintained. Rooftops and terraces often remain blocked or enclosed, cutting off evacuation routes entirely.

Citing a recent fatal nightclub fire in Goa, the petitioners warned that Majnu Ka Tila could face a similar tragedy if authorities continue to look away.

The High Court’s order now places the spotlight firmly on Delhi’s civic governance, sending a strong political and administrative message that public safety cannot be sacrificed at the altar of illegal commercial gain.
