Delhi HC Grants Bail To Amit In Rs 7 Crore Fraud Case

The Delhi High Court has granted bail to Amit, who has been in jail since 2022 in connection with a fraud case. He will be released on a personal bond of Rs 50 lakh and two sureties.

Justice Amit Mahajan, while granting bail, highlighted a crucial point. He said keeping Amit in jail without a trial violated his constitutional rights under Article 21. “The law mandates timely trials. If an accused person is held in jail for an extended period without trial, the courts must grant bail,” the judge said.

The court noted that charges have not been framed against Amit yet, and the prosecution has repeatedly sought more time to file a supplementary charge sheet.

Amit has been in jail for over two years. The court observed that there was no likelihood of the trial concluding soon. As a result, continuing his imprisonment without a trial would be unjust. The HC emphasized that the law favours bail over jail, aiming to strike a balance between the accused’s rights and the needs of the justice system.

The court said long-term imprisonment without trial is a key factor in deciding bail. The goal of incarceration is to ensure the accused’s presence during the trial. By imposing conditions, the court said, the risk of Amit fleeing can be mitigated.

Amit is accused of defrauding a company of Rs 7 crore. He allegedly issued fake payment receipts for rice container orders, leading to a complaint lodged with the Economic Offenses Wing. The complainant claims Amit’s actions resulted in significant financial loss. However, Amit insists that he has been framed in the case.
