Allahabad High Court Grants Conditional Bail To Man Accused Of Sharing Objectionable Video Against PM Modi

The Allahabad High Court has granted conditional bail to Javed, a resident of Meerut, who was accused of sharing an objectionable video about Prime Minister Narendra Modi on WhatsApp.

Javed has been in judicial custody since June 11 2025, following an FIR lodged against him at Jani Police Station in Meerut.

Justice Arun Kumar Singh Deshwal delivered the order, noting that the video did not prima facie fall under Section 152 of the Indian Penal Code, which pertains to acts endangering the sovereignty, unity, and integrity of India.

According to the prosecution, Javed allegedly uploaded a video that contained an edited audio clip suggesting a fabricated conversation between Prime Minister Modi and his Pakistani counterpart.

The purported dialogue depicted the two leaders discussing the idea of war to divert public attention and silence criticism for five years.

The court observed that while the content was inappropriate, it did not amount to a threat to national unity or integrity as defined under the law. It also took into account that the police had already filed a chargesheet in the case, indicating the completion of the primary stage of investigation.

Bail Conditions

Granting bail, the court directed Javed to cooperate with the ongoing legal process and refrain from uploading any objectionable content on social media. The court also instructed him not to engage in any criminal activity while out on bail.

The court made it clear that any violation of these conditions would lead to the immediate cancellation of bail.

The bench emphasised that individuals must use social media responsibly and must not misuse freedom of expression to spread misinformation or create unrest.

However, it reaffirmed that authorities must not use preventive detention or prolonged custody when offences do not directly endanger the nation’s integrity.
