Adani US Case: Vikas Singh, Mahesh Jethmalani Explain Significance Of Court Dismissal

A United States court’s dismissal of criminal charges against Gautam Adani and Sagar Adani has effectively closed the case and provided significant legal relief to the Adani Group, senior advocates Vikas Singh and Mahesh Jethmalani said.

The US District Court for the Eastern District of New York dismissed the proceedings after federal prosecutors sought permission to withdraw the indictment.

The case involved fraud and bribery allegations linked to solar power contracts in India, which the Adani Group consistently denied.

Speaking to ANI, Vikas Singh said reviving the criminal case would be extremely difficult after the court approved its dismissal. He stated that the alleged bribery transactions did not occur within American jurisdiction and referred to the Justice Department’s position that prosecutors should not have filed the charges.

Vikas Singh emphasised that the court subjected the withdrawal request to judicial scrutiny.

The judge sought an affidavit, raised questions and examined the prosecution’s grounds before granting permission.

Vikas Singh compared the process with Section 321 of India’s Code of Criminal Procedure, under which courts examine requests from prosecutors to withdraw cases.

According to him, the judge’s approval strengthened the legal significance of the dismissal.

Mahesh Jethmalani also welcomed the decision, arguing that weak allegations and insufficient evidence had undermined the original case. He said the outcome supported his earlier assessment that the proceedings lacked a strong legal foundation.

The court accepted the prosecutors’ grounds for withdrawal despite the judge’s concerns.

Gautam Adani welcomed the ruling, which closes the US criminal case without deciding every allegation on the merits.
