The Delhi High Court Rejects Bail Petition In Dowry Murder Case

The Delhi High Court rejected bail for a husband accused in a dowry murder case, citing serious allegations and the need to send a strong message to society.

Justice Swarn Kanta Sharma emphasized the continued harassment and abuse faced by married women for dowry. Granting bail, the court warned, could set a dangerous precedent.

The court observed that the woman’s death, allegedly due to torture over dowry demands, underscored the severity of the case. The court dismissed the bail plea accordingly.

In the aforementioned dowry murder case, the woman hanged herself at home in October 2021, leading to her death. During the investigation, her parents disclosed that her husband and in-laws had been harassing her for dowry.

In another case, the High Court quashed an FIR against a 61-year-old man accused of outraging a woman’s modesty. The condition for quashing the FIR was for him to plant 30 trees.

Justice Anoop Kumar Mehdiratta stated that since the parties settled the matter amicably, continuing the case would serve no purpose. Instead of a fine, the police directed the accused to plant trees in the local area.

He said that continuing the case would be nothing but a misuse of the time and resources of the court. Hence the FIR was quashed.  In this case, the Vasant Kunj police station lodged the FIR under Section 354 of the IPC. The judge also directed the petitioner to plant 30 trees in the local area or the Vasant Kunj police station area after contacting the competent authority, instead of imposing a fine.The height of the plants should be at least three feet.

The woman lodged a complaint, leading to the registration of an FIR against the accused under section 354 of the IPC (assault or criminal force to a woman with intent to outrage her modesty).This incident is of the year 2016.
