SC Grants Bail To K Kavitha In Delhi Excise Policy Case

The Supreme Court of India on Tuesday has granted bail to K Kavitha, a BRS leader who was behind the bars from months in connection to Delhi excise policy case. The investigation against K Kavitha was initiate by Enforcement Directorate and Central Bureau of investigation for alleged corruption in now scrapped  Delhi’s liquor policy.

However, It is important to note that court has imposed conditions on Kavitha, such as furnishing the bail bond of Rs 10 lakh. Furthermore she will have to deposit her passport to trial court.

A bench presided over by Justice B R  Gavai directed Kavitha to regularly attend the trial proceedings and cooperate with the expeditious disposal of the trial.

“The appellant is directed to be forthwith released on bail in both (CBI and ED) cases on furnishing bail bond of Rs 10 lakh each. She shall not make any attempt to tamper with evidence or influence the witnesses. The appellant shall deposit her passport with the trial court,” it ordered.

The Supreme Court Bench, including Justice K V Viswanathan, announced that the operative part of its order regarding Kavitha’s bail will appear online by 2 p.m. today.

The Court clarified that its decision to grant bail to Kavitha includes no observations on the merits of the case. This means that the bail order will not influence or prejudice the trial’s outcome.

Earlier, the Supreme Court had set August 27 for hearing Kavitha’s bail pleas. This followed a request from Additional Solicitor General (ASG) S.V. Raju, who asked for a week to respond on behalf of the Enforcement Directorate (ED).

On August 12, the Supreme Court agreed to review Kavitha’s pleas. The court directed both the Central Bureau of Investigation (CBI) and the ED to submit their replies. At that time, the Court had refused to grant any interim relief without first hearing from the investigative agencies.
