Provide A Copy Of Supplementary Charge-Sheet To Accused: Delhi HC On Excise Policy Case

In the latest development into the hearing of the Delhi Excise Policy Case, the Delhi High Court said that a copy of the chargesheet should be provided to the accused.

The Delhi High Court has released several instructions to prevent the delay in Excise Policy Case hearing. To save a great deal of time on document review and pre-hearing proceedings, the court ordered that whenever the investigating agency files a supplemental chargesheet against an accused party in court, both the hard copy and the soft copy should be provided to the other accused party on the same day.

Justice Swarn Kanta Sharma has issued this direction on the petition of businessman Arun Ramchandra Pillai. Pillai had said that there should be no hearing on framing of charges until the full investigation is done.

Judge Sharma has further stated that in order to avoid postponing the hearing, the accused must review the copy that the investigating agency has provided and notify the investigating officer of any errors within a two-day period.

In addition, the judge has requested that the relevant court hear the arguments on the allegations right away, taking into account the time constraint and granting each accused party a certain window of opportunity to submit their case.

After the Excise Policy Case, the Court Prioritized Cases of Divyang Litigants

The High Court said that it will hear the cases of Divyang litigants and lawyers on a priority basis. It will also give priority to the cases of Divyangs.

About this, the court has released a circular. In its circular, it stated that in order for the registry to hear Divyang litigants’ cases on a priority basis, the litigants’ attorneys must get in touch with the registry and notify it of their case. Additionally, the office of the Registrar (Listing) has requested all litigants, advocates for Divyangs, and their attorneys representing them in Divyang-related cases to notify them of any cases they have before the relevant bench of this court. By doing this, you can be confident that the concerned office will recognize them, list their cases in a hierarchical fashion, and handle their cases according to priority.
