Major Setback For RK Arora Owner Of Supertech As The Delhi High Court Denied His Petition To Have The Detention Lifted

RK Arora, chairman of Supertech, was taken aback when he was named in a money laundering case by the Delhi High Court. The Delhi High Court upheld the ED’s detention of RK Arora. His request for the Delhi High Court to overturn RK Arora’s arrest was denied. RK Arora, chairman and promoter of real estate major Supertech Group, was arrested by the ED in June 2023.

The investigating agency ED has filed a charge sheet against RK Arora. Ram Kishor Arora, the chairman of Supertech, filed a petition with the Delhi High Court on Friday challenging his detention by the Enforcement Directorate in a money laundering case, but it was dismissed on Friday.

Justice Dinesh Kumar Sharma ruled that none of Arora’s fundamental rights had been infringed and that there was no evidence to support a denial of his access to legal counsel or representation. According to the court, “the petitioner here failed to show that the petitioner’s arrest is in violation of Section 19 of the PMLA.”

Kapoor claimed that he was arbitrarily and unlawfully detained by ED on June 27 and that neither he nor anybody else was given notice of the reason for his detention. He further asserted that ED had wrongfully denied him his fundamental right under Article 22(1) of the Indian Constitution to consult with and be represented by a lawyer of his choosing.

However, ED disagreed with the appeal and claimed that the arrest of Kapoor complied fully with Section 19 of the PMLA. When Kapoor was brought before the court within 24 hours of his detention, the remand application was filed, according to the ED’s assertions. Senior Advocate Abhishek Manu Singhvi, along with Advocates R.K.Handoo, Yoginder Handoo, Siddharth Bhatti, Aditya Chaudhary, Ashwin Kataria, Garvit Solank, Bhupendra Premi and Yatin Dev appeared for the petitioner. Special Counsel Zoheb Hossain appeared for ED, along with Advocates Vivek Gurnani, Baibhav, and Mohit Godara.
