Jamaat-e-Islami Hind (JIH) Opposes Waqf Bill; Calls It Legislative Discrimination

Jamaat-e-Islami Hind (JIH) President Syed Sadatullah Husaini has strongly criticized the Waqf Amendment Bill, calling it ‘a highly condemnable move that paves the way for legislative discrimination against Muslims’.

He emphasized that the bill seeks to revoke key provisions of the Waqf Act, 1995, which previously granted Muslims rights similar to those enjoyed by other religious communities.

Furthermore, he pointed out that India’s endowment laws allow religious groups to manage their properties exclusively, a principle that remains intact for other communities.

In comparison, temples and other religious trusts continue to enjoy similar protections under different legal frameworks, highlighting the discriminatory nature of the proposed amendments.

However, the proposed bill selectively targets Waqf properties, stripping Muslims of their rights while leaving similar structures of other faiths untouched.

“This blatant legislative discrimination sets a dangerous precedent,” Husaini remarked.

Increased Government Interference

The bill introduces sweeping changes to the management of Waqf properties, increasing government interference and fundamentally altering their religious character.

Husaini argued that this is a direct violation of Article 26 of the Constitution, which guarantees religious minorities the right to manage their religious institutions.

He further alleged that despite receiving millions of objections from the public, the government ignored stakeholder concerns, making the consultation process a mere formality.

“The decision to pass the bill appears predetermined, rendering public opinion irrelevant,” Husaini stated.

He accused certain media outlets of misleading the public with false narratives, asserting that the bill does not address corruption, illegal occupation, or misuse of Waqf properties. Instead, he claimed, it weakens Waqf administration while failing to offer any real reforms.

Call For Political & Public Resistance

JIH has urged all secular parties, opposition leaders, and even allies of the ruling NDA to resist what it calls an ‘unjust bill’.

Husaini expressed disappointment over some parties that claim to be secular yet support the legislation.

“They must not succumb to political pressure from the BJP and engage in communal politics. If they fail to oppose this bill, history will remember their betrayal,” he warned.

JIH reiterated that Waqf properties are religious endowments, not government assets. Any attempt to dilute Waqf governance and increase state control is unacceptable.

If the bill is passed undemocratically, Husaini announced that nationwide protests would be expanded under the leadership of the All India Muslim Personal Law Board (AIMPLB) and other Muslim organizations.

Legal & Democratic Opposition To Continue

JIH vowed to challenge the bill through all constitutional, legal, and peaceful means.

“The struggle against this injustice will continue until the rights of the community are fully restored,” Husaini declared.

He called upon justice-loving citizens to stand against this discriminatory move and protect the secular fabric of the nation.

As debates over the bill intensify, the opposition to it highlights broader concerns about religious freedom, minority rights, and the balance between government oversight and religious autonomy in India.
