High Court: Five transfers In Five Years Are Prima Facie Malicious, Imposed Stay

Prayagraj: Allahabad High Court said that five transfers in five years are prima facie malicious. The transfer order of the petitioner was stayed. The state government has been asked to respond to the petition within three weeks. The petitioner was transferred by the Additional Director of Agriculture Directorate, Lucknow.

The court said that the petitioner will discharge his duties regularly and regular salary payment will continue. This order was given by Justice JJ Munir on Thursday on the petition of Puneet Singh appointed in compassionate quota.

The petitioner from Bulandshahr was appointed under compassionate appointment in 2019. He was first posted in Gautam Buddha Nagar district, where he remained posted till the year 2022. In the year 2022, he was transferred from Gautam Buddha Nagar to Kasganj, Etah. Then he was transferred from Kasganj to Meerut in the year 2022.

Again on 3 September 2022, the petitioner was transferred from Meerut to Bulandshahr. Whereas, on 29 June 2024, the petitioner was transferred for the fifth time in a short period of five years. This order has been challenged in the High Court. The court has stayed the transfer order and fixed the date of next hearing as 12 August.
