A division bench led by Chief Justice Mr. Justice Pritinkar Diwakar and Mr. Justice Ajay Bhanot had taken suo motu cognizance of the matter on the basis of a report published in a newspaper. The court had sought information about the practice of cremating dead bodies kept in mortuaries. During the hearing , it was told in the court that the last rites are performed within 72 hours.
After which state government has constituted a high-level committee to decide the guidelines in the case of the male skeleton of a girl kept in the Etawah mortuary for three years, which will give its suggestions. Additional Advocate General Manish Goyal told the court that the committee includes Director General Health, Director General Medical Education and Secretary Local Bodies.
He also presented the guidelines of the Human Rights Commission before the court, on which the court has fixed November 20 as the date of next hearing. In this case, High Court Bar Association General Secretary Nitin Sharma has been appointed as amicus curiae. They were also provided a copy of the Human Rights Commission’s guidelines. Now there will be a detailed debate in this matter on November 20.
On this the court asked what arrangements have been made by the government for disposal of such cases. On this, the Additional Advocate General said that the three-member committee will consider these matters and give its suggestions. After suggestions are received, the disposal of such cases will be considered further.
