Delhi Police Gets Approval To Prosecute Six Accused Under UAPA In Parliament Security Breach Case

In a significant development in the Parliament security breach case, Delhi Police has received approval to prosecute six accused under the stringent Unlawful Activities Prevention Act (UAPA).

The Patiala House Court extend the judicial custody of the accused until August 2, when the case to be hear next. The Delhi Police Special Cell had filed a 1000-page charge sheet against the six accused – Manoranjan D, Lalit Jha, Amol Shinde, Mahesh Kumawat, Sagar Sharma, and Neelam Azad – under Section 16A of UAPA.

According to sources, Delhi Lieutenant Governor V.K. Saxena had given approval to prosecute the accused under sections 16 and 18 of the UAPA. The review committee had examined the evidence collected by the investigating agency and found prima facie a case under UAPA against the accused.

The incident occurred on December 13, 2023, when two individuals jumped into the Parliament chamber, causing chaos and smoke. The accused were found to have entered the Parliament with passes recommended by BJP MP Pratap Sinha.

The UAPA amend in 2019 to include stricter penalties, and the Delhi Police request the necessary approval under the Act. The police grants 180 days to file the charge sheet, as opposed to the usual 90 days in IPC cases.

However, the case has sparked concerns about national security and the breach of Parliament’s security. The investigation is ongoing, and the accused are currently in judicial custody.
