The Delhi High Court has issued a summons against Tesla Power India Private Limited, a Gurugram-based company, and its US counterpart.
The summons is in response to a trademark infringement suit filed by Tesla Inc., helmed by tech entrepreneur Elon Musk.
Justice Anish Dayal presiding over the case has summoned both the Indian entity and Tesla Power USA LLC. The court directed them to furnish written statements regarding the allegations brought forth by Tesla Inc.
Moreover, the court has also taken cognizance of Tesla’s plea for interim relief in the case, scheduling a hearing for 22 May.
The crux of Tesla’s complaint revolves around the alleged unauthorized use of its trademark ‘TESLA’ by the defendants, coupled with the descriptive term ‘POWER USA’.
In response, the defendants clarified that their primary business focuses on ‘Lead Acid Batteries’, predominantly supplying them for various automotive, inverter, and UPS applications.
They explicitly stated that they are not engaged in manufacturing electric vehicles (EVs) and have no intention to venture into this domain.
Furthermore, they pledged not to market any EVs under their brand name ‘TESLA POWER USA’ or any other misleadingly similar brand.
Assuring the court, the defendants vowed not to issue promotional material or advertisements related to EVs under their trademark or trade name.
Additionally, they committed to refraining from using Tesla’s registered logos or devices.
The court acknowledged these undertakings and recorded them, thereby binding the defendants to adhere to these commitments.
In further proceedings, the court directed the counsel for the defendants to file a response along with supporting documents within three weeks.
The court said it’s important to share this response with the opposing counsel, allowing for a rejoinder if necessary.
With the case poised for further deliberation, stakeholders await the forthcoming developments as the legal battle unfolds in the Delhi High Court.
