Delhi High Court Issues Notice To Brilliant Etoile Private Limited Over Yuvraj Singh’s Petition

In a recent legal development, the Delhi High Court has issued a notice to real estate company Brilliant Etoile Private Limited in response to a petition filed by former cricketer Yuvraj Singh. The notice demands a formal reply from the company regarding the issues raised by Singh, who has sought the appointment of an arbitrator to resolve the ongoing dispute.

Yuvraj Singh, a celebrated figure in Indian cricket, booked a luxury flat in Hauz Khas, Delhi, with Brilliant Etoile Private Limited in 2021. The flat, priced at approximately Rs 14.10 crore, expect to be a premium property. However, upon receiving the possession letter in November 2023, Singh inspected the flat and found it to be of substandard quality. The former cricketer alleges significant delays in the handover of the property and asserts that the quality of construction and finishing did not meet the promised standards.

The allegations extend beyond just delays and quality concerns. Represented by Rizwan Law Associates, Singh has pointed out that the builder compromised on various aspects, including fittings, furnishings, lights, and overall finishing. In addition to these grievances, Singh has accused the real estate firm of violating his personal rights and misusing his brand value.

Memorandum of Understanding

According to Singh, the terms of the Memorandum of Understanding (MoU) explicitly stated that his image could not be used for promotional purposes after November 2023. Despite this, the builder allegedly continued to utilize his photo on billboards, project sites, social media posts, and various articles, thereby infringing upon the agreed terms.

Earlier, the law firm representing Singh serve with a notice claiming damages due to the project’s delay, further complicating the matter. The ongoing conflict has now escalated to the point where Singh is demanding the intervention of an arbitrator to ensure a fair resolution.

The Delhi High Court’s notice to Brilliant Etoile Private Limited marks a significant step in this high-profile case. The court has asked the real estate company to provide a detailed response to the allegations made by Singh. As the legal proceedings unfold, the outcome of this case could have broader implications for both the real estate sector and the use of celebrity endorsements in property promotions.

For now, all eyes remain on the forthcoming responses and the court’s subsequent decisions, which will determine the next steps in resolving this dispute between Yuvraj Singh and Brilliant Etoile Private Limited.
