Bibhav Kumar’s Judicial Custody Extended To July 16 In Swati Maliwal Case

Bibhav Kumar was taken into custody on May 18, following allegations from Aam Aadmi Party’s Rajya Sabha MP Swati Maliwal that he had assaulted her at Kejriwal’s residence on May 13.

Initially, his bail request was rejected by a city court on May 27, which noted the serious nature of the charges against him and the possibility of witness tampering.

On June 7, the Tis Hazari court in Delhi denied bail to Bibhav Kumar, emphasizing the gravity of the accusations leveled against him.

Subsequently, on July 1, the Delhi High Court deemed Kumar’s plea challenging his arrest admissible and asked for the Delhi Police’s response.

The FIR against Kumar, filed on May 16, includes charges under various sections of the Indian Penal Code such as criminal intimidation, assault with intent to disrobe, and attempted culpable homicide.

In his plea, Kumar argues that his arrest was illegal and violated procedural norms laid out in section 41A of the Code of Criminal Procedure. He asserts that his arrest was motivated and occurred while his anticipatory bail application was pending, which he claims infringed upon his fundamental rights and legal protections.

Additionally, Kumar seeks compensation for what he deems an unlawful arrest and requests disciplinary action against officials involved in the decision-making process leading to his arrest.
