Arrest Is Illegal, Says Kejriwal’s PA Bibhav Kumar

Arvind Kejriwal’s PA, Bibhav Kumar, has taken his arrest to the High Court, claiming it violates Supreme Court guidelines.

Bibhav Kumar was arrested in connection with the assault case involving Aam Aadmi Party (AAP) Rajya Sabha member Swati Maliwal.

He has petitioned for the declaration of his arrest as illegal and demanded compensation. He also demanded departmental action against the responsible police officers. The High Court is set to hear his plea on Friday.

Bibhav’s advocate, Rajat Bhardwaj, argues that his arrest breaches Section 41A of the CrPC. Despite a previous rejection of his bail plea by a sessions court on Monday, the High Court has scheduled a hearing for May 31. The petition demanded immediate attention.

Swati Maliwal alleges that Bibhav assaulted her at the Delhi Chief Minister’s official residence on May 13.

Following his arrest on May 18, he was initially remanded to five-day police custody by a magistrate’s court. Later, he was transferred to four-day judicial custody, and subsequently, to three-day police custody on May 28.

An FIR was filed against Kejriwal’s PA Bibhav Kumar on May 16 under various sections of the IPC, including criminal intimidation, assault, and attempted culpable homicide not amounting to murder.
