Supreme Court
ED Director: ED (Enforcement Directorate) director Sanjay Kumar Mishra has got relief from the Supreme Court. The apex court has upheld the Centre’s order to give third extension to Sanjay Kumar Mishra. The court said that the government has the power to amend for extension. The ED director will remain on his post till July 31. The court has limited the third extension of the term of the director till July 31. BR Gavai, Justice Vikramnath and Justice Sanjay Karol have given this decision.
However, the Supreme Court upheld an amendment to the DSPE and CVC Act, giving the Center the power to extend the tenure of the CBI chief and ED director by 3 years beyond their mandatory two-year term. Congress leaders Randeep Surjewala, Jaya Thakur, TMC leaders Mahua Moitra, Saket Gokhale and others had filed a petition against it. On May 8, the Supreme Court had reserved judgment on 11 petitions challenging the extension of ED Director Sanjay Mishra’s tenure, which has now been quashed.
During the hearing of the case, the Central Government had assured in the court that no new extension will be given after the completion of the third service extension period of November 2023, because the government will not go beyond the law.
