In a significant judgment, the Allahabad High Court determined that teachers serving as principals in charge must receive the same salary as regular principals.
This decision came in response to a petition filed by Saurabh Pandey and 35 other educators who are currently serving as in-charge principals in various schools across Rampur but are receiving the salary of assistant teachers.
The court has mandated that the petitioners receive their pending salary, equivalent to that of a regular principal, within two months.
Justice Prakash Padia, who presided over the case, emphasized that the petitioners, despite fulfilling the responsibilities of a principal, received compensation as assistant teachers, which was unjust.
Referencing previous orders by the Supreme Court and the High Court, Justice Padia said, “The petitioners fulfill the responsibilities of a principal while receiving the salary of an assistant teacher. In this situation, they deserve the same salary as a regular principal.”
He underscored the contributions and services provided by these educators in their roles.
The petitioners’ counsel, citing the Raj Kishori Kushwaha vs. UP case as precedent, argued that the District Basic Education Officer in Rampur should pay the proper salary for the principal’s post to the petitioners.
The court accepted this argument and instructed the District Basic Education Officer, Rampur, to verify the petitioners’ roles as in-charge principals.
Upon confirmation, they are to be compensated with the appropriate principal’s salary along with the arrears.
