Allahabad High Court Criticizes Use Of ‘Retired’ For Sitting Justices; Calls It A Protocol Breach

The Allahabad High Court has voiced its strong disapproval of using the term ‘retired’ before the names of sitting justices, deeming it a breach of established protocol.

The court emphasized that even after a High Court judge’s retirement, the honorific Mr. Justice should continue to precede their name.

The court’s comments came during a hearing on a petition filed by Luvkush Tiwari concerning a service-related matter.

Justice JJ Munir, addressing the issue, criticized the misuse of the term ‘retired’ as a prefix rather than a suffix, suggesting that the term should b properly utilized in accordance with protocol.

The criticism arose after the Additional Chief Secretary Home submitted an affidavit that incorrectly referenced a retired High Court judge by using the term ‘retired’ improperly.

The court described this misuse as extremely painful and a clear violation of the correct procedural norms.

In response, the court has instructed the Registrar Protocol to compile a report detailing the issue and to present any existing guidelines related to judicial protocol.

The court’s action underscores the importance of adhering to formal protocols in all judicial communications and documentation.
