The Allahabad High Court has ruled against a petitioner’s appeal seeking divorce on the grounds of insanity, highlighting the necessity for substantial evidence in such claims.
The division bench, led by Justice Saumitra Dayal Singh and Justice Donadi Ramesh, upheld the lower court’s decision to deny the divorce filed by a Fatehpur resident.
The petitioner, married since 2005 and separated from his wife since January 2012, had initially sought divorce from his spouse citing insanity and cruelty.
Despite their seven-year marriage and two daughters, the family court dismissed the petition for lack of sufficient proof.
Challenging this decision, the petitioner appealed to the High Court, which clarified that proving insanity as a basis for divorce requires demonstrating an incurable mental illness.
The court stipulated that the illness must involve significant mental impairment, such as psychopathic disorder or severe behavioral abnormalities.
The High Court also noted that the respondent, an educated graduate, had not exhibited any conduct that would substantiate the allegations of severe mental disorder.
With no concrete evidence presented to contest the lower court’s order, the High Court dismissed the appeal, affirming the initial judgment.
