PIB Fact Check Rejects Claims About Bankers’ Books Evidence Bill, 2026

The Press Information Bureau’s (PIB) Fact Check unit has termed the claims made in an article by Moneylife India regarding the proposed Bankers’ Books Evidence Bill, 2026.

The article alleged that the Bill would allow police to access bank records without a court order, leave customers with no protection against wrongful disclosure of financial data, and remove judicial scrutiny over the production of records.

According to PIB, these claims do not reflect the provisions of the proposed legislation.

PIB clarified that the Bill does not confer any new powers on the police. Instead, it provides that certified copies of bank records may be produced and accepted in place of original records during a police investigation or inquiry conducted under the Bharatiya Nagarik Suraksha Sanhita, 2023.

The fact-check further stated that the proposed law reinforces that investigating agencies cannot insist on the production of original bank records during such investigations, as certified copies would be sufficient.

Addressing concerns over judicial scrutiny, PIB said that a court performing judicial functions can permit the inspection of bank records or the production of certified copies in judicial proceedings only through a lawful order. It also noted that the Bill allows banks to oppose any direction seeking inspection of records or production of certified copies.

In such cases, the court must hear the bank before issuing any further direction.
