Haldwani Protest: 50K people can’t be removed overnight, we need a practical solution, says SC

Haldwani Protest: The Supreme Court has stayed the High Court’s order to remove encroachment from railway land in Banbhulpura area of ​​Haldwani. During the hearing, the Supreme Court said that we are issuing notices to the Railways and the State Government. There should be a ban on further occupation. Court says that 50,000 people cannot be displaced within 7 days. The next hearing in this matter will be on February 7.

The Supreme Court said that 50 thousand people cannot be made homeless overnight. Railways should prepare a plan for development as well as rehabilitation and rights of these people. The Supreme Court said that we have to find some practical solution. There are many angles arising from the nature of land, nature of rights, nature of ownership etc., which should be examined.

It is not clear that this land belongs to the Railways – Colin Gonsalves

The case was heard by a bench of Justice Sanjay Kishan Kaul and Justice Abhay S Oak. Colin Gonsalves argued on behalf of the petitioners. He told about the order of Nainital High Court and said that it is also not clear that this land belongs to Railways. It has also been said in the order of the High Court that this is the land of the state government. Thousands of people will be affected by this decision.

How can you ask to vacate in 7 days?- Supreme Court

The Supreme Court told the government that even if it is your land, some people have said that it is from before 1947. They took land on lease and built houses, someone bought it in auction, what will happen to them. Development should be allowed, but if people stay for so long then rehabilitation should be allowed. How can you ask to vacate in 7 days?

Will take further action as per the order of the court- Dhami

At the same time, after the decision of the Supreme Court, the Chief Minister of Uttarakhand Pushkar Singh Dhami said that it is the land of the Railways and the case of the Railway Department was going on in the High Court. We have already said that whatever will be the order of the court, we will take further action accordingly.

On January 1, the Railways issued a public notice and on January 2, warned all the encroachers to remove their encroachments within a week. After which, in protest against the demand for relocation and removal of encroachment, the local people are continuously taking out protests, demonstrations and candle marches.
