Supreme Court Stays Allahabad High Court’s Adverse Remarks Against UP ACS Sanjay Prasad

The Supreme Court has granted significant relief to Uttar Pradesh Additional Chief Secretary (Home) Sanjay Prasad by staying an Allahabad High Court order that contained adverse observations against him.

Justices Prashant Kumar Mishra and Atul Chandurkar passed the interim order while hearing Sanjay Prasad’s appeal.

A woman filed a petition after police failed to trace her abducted minor daughter.

During the proceedings, the Allahabad High Court examined the implementation of earlier directives issued in the case concerning police investigation reforms in Uttar Pradesh.

Justice Vinod Diwakar observed that the Uttar Pradesh Police had failed to comply with those directions.

The court subsequently sought an explanation from Sanjay Prasad in his capacity as the head of the Home Department.

The High Court noted that the state government had adopted a delaying approach and was considering challenging the reform directives before the Supreme Court.

On June 3, the Allahabad High Court expressed strong displeasure over Sanjay Prasad’s conduct. The court stated that his actions appeared to undermine judicial authority and obstruct police and administrative reforms.

The High Court directed the Department of Personnel and Training (DoPT) to place its observations on record. It said authorities could consider those remarks while evaluating future promotions or key appointments involving the officer.

The court further observed that failure to act against such conduct could weaken the effectiveness of judicial orders.

Challenging these findings, Sanjay Prasad approached the Supreme Court. The apex court stayed all directions and observations issued against him in view of the matter’s seriousness.

The stay order has provided immediate relief to the senior bureaucrat. It has also removed the immediate risk of adverse entries affecting his service record, future postings and promotional prospects pending further proceedings.
