Increasing The Quantity And Charging The Old Price Despite The GST Reduction Is A ‘Fraud’, Says Delhi High Court

In a landmark ruling, the Delhi High Court declared that GST rate cuts must directly benefit consumers through lower prices.

A bench of Justices Pratibha M Singh and Shail Jain stated that increasing quantity instead is not acceptable at all.

The court emphasised that charging the old price while silently increasing quantity defeats the very purpose of tax reduction. It said manufacturers cannot bypass passing on tax benefits by giving extra grams or Diwali offers in product packaging.

This ruling came in response to a petition filed by Sharma Trading Company, a distributor of Hindustan Unilever Limited.

The case centred around a 2018 complaint where Vaseline allegedly retained prices despite a GST reduction on its product. The distributor defended it by claiming they added 100ml extra to the product, hence keeping the price unchanged.

However, the court rejected this justification, calling the act of increasing quantity ‘fraud’ that restricts consumer choice unfairly. It ruled that tax benefits should reflect in proportionate price cuts, not in promotional packaging or free quantity schemes.

The court added that companies must prepare in advance for such tax changes, not hide behind old stock excuses. It reiterated that offering extra quantity without consumer consent and keeping prices unchanged cannot be justified under any circumstances.

Justice Singh said consumers deserve transparency and the real benefit of tax relief, not marketing gimmicks replacing price cuts.

The court criticised tactics that deceive consumers under the pretext of added value, calling them misleading and manipulative behaviour. It firmly stated that no pretext—whether schemes, offers, or old stock—can deny consumers their rightful GST-related price reduction.

The court also underlined that such practices limit consumer decision-making by presenting manipulated price-value propositions.

This decision is expected to set a precedent for GST compliance in pricing and packaging across India’s fast-moving consumer goods sector.

Legal experts believe this ruling strengthens consumer rights and enforces corporate accountability in tax-related price transitions.
