The Delhi High Court has granted major relief to Lieutenant General (Retired) Inderjit Singh by dismissing the rape case.
Justice Amit Mahajan declared the allegations against the 70-year-old retired Indian Army officer as entirely false, absurd, and fabricated.
The court emphasised that continuing such proceedings without credible evidence would clearly constitute an abuse of the legal process.
Consequently, the High Court set aside the trial court’s order and quashed the FIR registered against the accused officer.
It was observed that the complainant failed to present any credible or corroborative evidence supporting her serious and damaging allegations.
The court further stated that forcing the accused to face trial without evidence would amount to a travesty.
Additionally, the medical examination of the complainant revealed no injuries, undermining the claims of physical assault or resistance.
The video footage presented by the complainant also displayed no torn clothing or visible signs of physical harm.
The court remarked that such an attack by a 70-year-old man in a park was entirely implausible. It further noted the presence of several people in the park, making the alleged incident seemingly impossible.
The order came in response to Singh’s petition challenging the trial court’s directive to register an FIR.
According to the High Court, the magistrate ignored the DCP’s report, which had raised doubts regarding the allegations.
Justice Mahajan criticised this oversight, stating that judicial authorities must carefully examine such reports before ordering criminal proceedings.
The court stressed that false cases deeply harm an individual’s reputation and must be thoroughly scrutinised before acceptance. It concluded that the complaint appeared motivated by malice, intending to harass and tarnish the retired officer’s dignity.
