Delhi Court to Hear Plea Seeking FIR Against Sonia Gandhi Over Voter List Entry

A Delhi court is set to hear a criminal revision petition against Congress Parliamentary Party Chairperson Sonia Gandhi on Saturday, concerning allegations that her name was fraudulently entered in the electoral rolls before acquiring Indian citizenship.

The petition, filed by advocate Vikas Tripathi, challenges the September 11, 2025, order of Additional Chief Metropolitan Magistrate Vaibhav Chaurasia, who had dismissed a complaint seeking registration of an FIR and a police probe into the alleged wrongful inclusion.

According to the petitioner, Sonia Gandhi’s name first appeared in the New Delhi constituency’s electoral roll in 1980, nearly three years before she formally acquired Indian citizenship in April 1983.

The plea contends that such inclusion could not have occurred without forged or fabricated documents and amounts to a cognisable offence. It further claims that her name was deleted in 1982 and re-entered in 1983 after she became a citizen.

Court Proceedings and Legal Position

On December 9, 2025, Special Judge (PC Act) Vishal Gogne of the Rouse Avenue Courts agreed to examine the revision plea and issued notice to Sonia Gandhi and the Delhi Police, listing the matter for further hearing.

Earlier, the Magistrate Court had declined to order registration of an FIR, holding that judicial intervention in such matters would amount to unwarranted transgression into areas entrusted to Constitutional authorities. It observed that Article 329 of the Constitution bars judicial interference in electoral matters except through election petitions.

In response, Sonia Gandhi termed the allegations politically motivated and based on misleading facts, maintaining that citizenship issues fall under the Central government’s jurisdiction while electoral roll disputes lie with the Election Commission of India.

She denied any forgery and described the proceedings as an abuse of legal process.

The issue has drawn political reactions, with the BJP raising allegations of voter list manipulation, while the Congress has dismissed the claims. Congress General Secretary Priyanka Gandhi Vadra questioned the existence of evidence supporting the allegations and defended her mother’s record.
