Delhi Court Defers Hearing On Plea Seeking FIR Against Sonia Gandhi

A Delhi court on Monday adjourned the hearing on a criminal revision petition seeking registration of an FIR against Congress Parliamentary Party Chairperson Sonia Gandhi over the alleged inclusion of her name in the electoral rolls before acquiring Indian citizenship.

The matter, being heard at the Rouse Avenue Court, has been listed for April 18 after the petitioner concluded his arguments, while submissions on behalf of Sonia Gandhi remained inconclusive.

The revision petition, filed by advocate Vikas Tripathi, calls for an investigation into the alleged irregular entry of Sonia Gandhi’s name in the voter list without Indian citizenship.

During the hearing, the petitioner’s counsel argued that the case involves a declaration made by a foreign national and could not have occurred without forged documents or fraudulent means.

He told the court that certified copies of electoral rolls had been obtained and placed on record to establish a prima facie case, warranting a probe into alleged forgery and fabrication of documents.

However, arguments from Sonia Gandhi’s side were not completed and will continue during the next hearing.

Defence Calls Allegations ‘Politically Motivated’

In an earlier order dated December 9, 2025, Special Judge (Prevention of Corruption Act) Vishal Gogne agreed to examine the revision plea and issued notice to Sonia Gandhi and the Delhi Police.

The case follows a Magistrate Court ruling that had dismissed the complaint seeking an FIR, observing that the judiciary cannot undertake inquiries that would lead to unwarranted interference in matters assigned to constitutional authorities.

It cited Article 329 of the Constitution, which limits judicial intervention in electoral issues outside election petitions.

Opposing the plea, Sonia Gandhi has termed the allegations “politically motivated”, baseless, and based on incorrect and misleading facts. She stated that citizenship matters fall under the Central government’s jurisdiction, while electoral roll disputes are the domain of the Election Commission of India.

She further argued that no credible evidence has been presented and described the proceedings as an abuse of the legal process.

The issue has sparked political debate, with the BJP alleging voter list manipulation, while Congress has rejected the claims as ‘baseless’ and ‘retaliatory.’
