The Rouse Avenue Court has sent AAP MLA Naresh Baliyan to police remand until December 13 in a case under the Maharashtra Control of Organised Crime Act (MCOCA). Special Judge Kaveri Baveja passed the order. Delhi Police’s Crime Branch arrested Baliyan on Wednesday after he was granted bail in another case.
During the hearing, Baliyan’s lawyer argued that the Rouse Avenue Court lacked jurisdiction to hear MCOCA cases. He claimed that the Crime Branch had no evidence against Baliyan and had failed to serve a proper notice, violating Supreme Court guidelines.
The police arrested Baliyan based on an alleged audio conversation between him and gangster Kapil Sangwan, who resides in Britain. The audio clip, which surfaced on social media, reportedly discusses extortion from businessmen. Delhi Police stated that this conversation took place in 2023.
Kapil Sangwan, also known as a notorious gangster, has been implicated in multiple high-profile crimes, including the Haryana Nafe Singh murder case. He has been living in Britain for the last five years.
Baliyan’s lawyer dismissed the allegations, calling the arrest a political move to tarnish Baliyan’s reputation and hinder his election campaign. He asserted that Baliyan was only helping victims of extortion and had no ties to any criminal activities.
The police maintain that both Baliyan and Sangwan are residents of Najafgarh, Delhi, and share a connection. Authorities allege that Sangwan is also the mastermind behind the murders of Ballu Pehelwan and BJP leader Surendra Matiala.
The court will next review the case on December 13.
