Gyanvapi : Seeking Stay On Orders, Masjid Side Moves To Supreme Court

After the orders by Varanasi court, Gyanvapi masjid side is likely to move to Supreme Court to seek urgent listing of their case .The varanasi court has ordered the Archeological Survey Of India (ASI) survey in the disputed Gyanvapi mosque premises except for Wazukhana (place for ablution) where the ‘Shivling’ was found will be kept out of the province of the survey. Varanasi court on Friday ordered for the scientific survey of the Gyanvapi mosque complex.

The case will be presented before the Chief Justice of India DY Chandrachud on Monday, July 24. The Masjid Committee has asked the district judge in the Varanasi court to halt all proceedings in the Gyanvapi mosque dispute.

The Committee submitted the petition during the first week of July. However, in view of the recent District Court ruling mandating the ASI survey in the grounds of the Gyanvapi mosque, an urgent listing is being requested.

The request is being made given the May 19 order by the Supreme Court which had deferred a high court order for the ASI survey of the alleged ‘Shivling’, which the Hindu side claims is situated inside the Wazukhana of Gyanvapi mosque. An appeal by Anjuman Intezamia masjid would be filed in the court tomorrow. The plea seeks to mark a stay on all proceedings pending in the varanasi court before the district judge.

ASI survey allowed

On friday district judge AK Vishwesha passed the orders allowing the survey by ASI the court demanded the survey must be done without causing any damage.

“I have been informed that the court has approved and an ASI survey would be conducted” said Adv Vishnu Shankar Jain who represents the Hindu side, outside the court. During arguments. Jain told the court that the Temple-Gyanavapi Masjid dispute would be resolved only when the Archeological Survey department investigates the entire mosque complex.

The Allahabad High Court’s order, upholding the maintainability of a suit filed by five Hindu women worshippers before a Varanasi court seeking the right to worship inside the Gyanvapi mosque has been challenged by the Masjid committee.
