Delhi Liqour Policy Case: “If ED Wishes To Arrest Me, They Should Proceed,” Says Kejriwal’s Lawyer During Protection Petition Hearing

Delhi Liquor Policy Scam: Hearing underway in Delhi High Court on Kejriwal’s petition seeking protection from arrest in the Delhi Liquor Policy Scam case. During the court proceedings, the ED objected to Kejriwal’s petition, arguing that the main petition’s maintainability must be decided before considering this demand.

Reference was made to the DK Shivkumar case. Kejriwal’s lawyer, Abhishek Manu Singhvi, invoked the DK Shivkumar case in seeking protection. When the court inquired whether Kejriwal responded to the ED summons, Singhvi asserted that they replied to all ED summons.

Singhvi urged the court to grant a two-month extension, citing a new summons issued on March 16 amid elections. He emphasized that Kejriwal, being the national convener of the party, deserves this extension since the investigation has been ongoing since 2020.

Singhvi questioned, “Don’t I have the right to know in what capacity I am being called?” He expressed readiness for his arrest but requested that it be deferred until after the elections, labelling the summons as “election summons.”

The High Court directed Kejriwal’s lawyer to ascertain the required documents from the investigating agency, emphasizing the necessity for Kejriwal’s involvement in the investigation to understand the materials needed.

In response, the ED asserted that they possess ample evidence and are summoning Kejriwal in his individual capacity. They highlighted Kejriwal’s failure to appear before the investigating agency and emphasized the absence of legal provisions to prevent anyone’s arrest.
